Terms of Service

These Terms of Service ("Terms") govern your use of the Termite Identifier application ("the App") published by Bulpara Inc ("we", "us", "our"). By downloading or using the App, you agree to these Terms.

1. Service Description

Termite Identifier is an iOS application that examines a photograph of a winged insect, or of shed insect wings, and reports whether it appears to be a termite swarmer, a flying ant, or whether it cannot tell. Photographs are processed on our servers by two independent AI vision models. The App also provides an inspection checklist of the signs a professional looks for, and a regional swarm calendar.

2. Not an Inspection, and Not Professional Advice

Termite Identifier is an identification aid. It is not a pest inspection, and it is not pest-control, structural, medical, or veterinary advice. You understand and agree that:

• The App identifies what appears in a single photograph. It cannot tell you whether your home is infested, how far any infestation has spread, or what treatment is appropriate. Only a licensed inspector on site can do that.
• A FLYING ANT result means the insect in that photograph did not appear to be a termite. It is not a certification that your property is free of termites.
• A NOT SURE result is a deliberate and normal outcome. The App is designed to decline rather than guess when its two models disagree or when the photograph is inadequate.
• Results depend on photograph quality, focus, lighting, the angle of the specimen, and the presence of a size reference in the frame. Look-alike species — booklice and mayflies in particular — can be misread, especially without a size reference.
• The swarm calendar gives typical regional windows for common US species. Actual swarming varies with weather, year, and local conditions, and the regional pressure estimate derived from your ZIP code is approximate.
• The App does not address insect bites, stings, or any health effect, and must not be used for that purpose.
• Any termite or not-sure result should be confirmed by a licensed pest-control professional before you act on it. So should a flying-ant result, if other signs of infestation are present.

3. Acceptable Use

You agree to use the App only for lawful purposes and only on photographs you have the right to submit. You agree not to:

• Present the App's output as a professional inspection, a certification, or a disclosure in a property transaction
• Submit photographs of people, private documents, or content unrelated to insect identification
• Reverse engineer or decompile the App, or attempt to extract, resell, or rehost the identification service
• Attempt to circumvent subscription restrictions or free-tier limits, including by automated or scripted submissions
• Use the App in any manner that violates applicable laws or third-party rights

4. Subscriptions & Billing

• Free tier: No charge. Three identifications in total, both capture modes, the full inspection checklist and safety guidance, the swarm calendar, and your three most recent scans. Identifications that fail or are cancelled are not counted.
• Premium Monthly: $7.99/month. Unlimited identifications, the annotated breakdown of each check on your own photo, species-level identification, swarm alerts, and full scan history.
• Premium Annual: $39.99/year (save 58% vs. monthly), with a 7-day free trial. Same Premium feature set as monthly.
• "Unlimited" means unlimited for ordinary household use. We may apply reasonable measures against automated, commercial-scale, or abusive volumes that are inconsistent with personal use.
• Subscriptions are billed through the Apple App Store and are subject to Apple's Terms of Service.
• Payment is charged to your Apple ID at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• You can manage and cancel your subscription through your Apple ID settings. Cancellation takes effect at the end of the current billing period.
• If you cancel during a free trial period before the trial ends, you will not be charged.
• We reserve the right to change pricing with 30 days' notice. Existing subscribers retain their original price for the remainder of the active term.

5. Your Content

You retain all rights to the photographs you submit. You grant us a limited licence to transmit and process a submitted photograph solely to produce your identification result, using the providers named in our Privacy Policy. That photograph is deleted as soon as the check completes; we do not retain it, and we do not use it to train AI models. Your scans, checklists, notes, and photographs are stored on your device and are removed when you delete them or the App.

6. Intellectual Property

The App, including its design, code, copy, and packaged content, is owned by Bulpara Inc and is protected by copyright and other intellectual property laws. You receive a limited, non-exclusive, non-transferable licence to use the App for its intended purpose.

7. Third-Party Services

Identification requires an internet connection and depends on third-party infrastructure, including Apple, Replicate, and Cloudflare. Interruptions to those services may make identification temporarily unavailable. The swarm calendar and your saved scans remain available offline.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED, THAT ANY IDENTIFICATION WILL BE CORRECT, OR THAT THE APP WILL DETECT OR RULE OUT A TERMITE INFESTATION.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BULPARA INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO:

• Decisions made or deferred on the basis of an identification, including whether to book an inspection, treat, purchase, sell, or disclose
• Property damage, structural damage, or repair and treatment costs, whether or not an infestation was identified
• An incorrect identification, a missed identification, or a NOT SURE result
• Reliance on the swarm calendar, the inspection checklist, or any other guidance in the App
• Subscription-related charges that fall under Apple's billing policy

Our total liability for any claim relating to the App shall not exceed the amount you paid us for it in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Bulpara Inc from any claims, damages, or expenses arising from your use of the App, including any use of its output in a property transaction, dispute, or professional context.

11. Termination

We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or the business.

12. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of the App after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws provisions.
